CONTENT OF THE CONTRACT

The purpose of the contract is the rental of the motorhome between Chelston Motorhome Hire and the hirer.

RENTAL PERIOD

Our minimum UK hire periods are as follows:

  • Low Season 4 Nights – 1st October until 29th February.
  • Mid Season 4 Nights – 1st March until 31st May and September 1st until 30th.
  • High Season 7 Nights – 1st June until 31st August.

All hires that coincide with special events and festivals may require a minimum of 10 nights booking.

DRIVERS, DRIVING LICENCE

Drivers:

Each driver must be between the ages of 25 and 69; the driver must hold the necessary driving licence to drive a motorhome and have a minimum of two years’ experience as a qualified driver. All drivers must be present at the time of collection and have their driving licence and required documentation with them.

For an additional driver there will be a charge of £30 per week.

There is a limit to 2 drivers per motorhome.

Should the driver be responsible for an accident in the 3 years previous to the hire collection date then the driver will not be approved by Chelston Motorhome Hire to drive the motorhome . The motorhome may only be driven by the drivers named at the time of renting and be in compliance to the Terms and Conditions.

Licence and Identification (UK Drivers):

Chelston Motorhome Hire motorhomes are up to a maximum Gross Vehicle Weight of 3500kg.

The  driver must have a Category B or B1 licence. Some endorsements are acceptable i.e. speeding and parking. A maximum of 6 points on the licence may be permissible.

Chelston Motorhome Hire reserve the right to refuse hire to drivers; if you are unsure about the above, please call us at your earliest opportunity to discuss further.

Before the date of hire – each driver will need to visit www.gov.uk/view-driving licence to create a ‘licence check code’. This code will need to be presented to Chelston Motorhome Hire on collection of the motorhome with the driver’s passport and driving licence.

If the Passport is not available then two items from the list below must be produced:

  • A utility bill, bank statement or credit card statement within the last three months, stating the drivers’ home address.

Please note the code is only valid up to 21 days. If the hirer is unable to obtain their code, please inform Chelston Motorhome Hire immediately for further advice.

Licence and Identification (Non UK- EU Only)

Each driver must have an EU Driving Licence,  this must cover the driver to drive the Motorhome they have booked to hire.

As well as their driving licence, each driver needs to produce a Passport plus two items from the list below:

  • A utility bill, bank statement or credit card statement within the last three months, stating the drivers’ home address.

RENTAL CHARGE, INSURANCE

The rental charge is the basic charge that is quoted at the time of booking for the rental of the motorhome and is part of the contract between the hirer and Chelston Motorhome Hire. The rental charge includes comprehensive vehicle insurance that has an insurance excess payable by the hirer.

LIABILITY, FULLY COMPREHENSIVE MOTOR INSURANCE COVER

In cases of damage to the motorhome, loss of the motorhome or breach of the rental contract, the hirer is general liable for all sums according to the general laws of liability.

The hirer will also be liable for damage/ loss if they do not report the accident within the specified time or fails to supply / provide false information to Chelston Motorhome Hire.

The indemnity against liability does not cover any breakages or damage that is not caused due to a Road Traffic Accident as defined in the previous section ‘Rental Charge, Insurance’.

The insurance excess is £1000 for UK and £1250 for EU hire.

The insurance does not include any personal insurance or cover of personal possessions.

The following is not covered by the vehicle insurance and are chargeable on a case by case basis, these costs may be recovered from the Security Deposit:

  • Damage to the Bike Rack.
  • Damage to the upholstery/ furniture.
  • Damage to the TV/ DVD player.
  • Damage to the television aerial.
  • Lost or broken keys.
  • Damage to the windscreen or side/ rear windows.
  • Tyre damage/ wheel damage.
  • Motorhome bodywork damage over 2 metres in height.
  • Damage caused by vandalism or forced entry.
  • Damage caused by abnormal, deliberate or negligent act

COLLISION DAMAGE WAVER

Chelston Motorhome Hire would recommend that the hirer protects the insurance excess by taking out a Collision Damage Waver policy, these policies are provided by a Third Party.

Should you select to use a collision Damage Waver, the insurance excess is still payable to Chelston Motorhome Hire but by taking out a Collision Damage Waver policy  it will enable you to protect the insurance excess should the motor home be involved in a road traffic accident.

The Security Deposit is to cover the cost of the insurance excess and may also be used to recover the cost to rectify any other damage that occurs during the hire period.

SECURITY DEPOSIT

A security deposit of a value equivalent of the insurance excess is required to cover the insurance excess plus it may also be used to recover the cost to rectify any other damage through mis-use of the motorhome or the motorhome being returned in a unacceptable condition. This deposit must be paid by means of Master or Visa card, no later than 5 working days before the collection date of the motorhome. No other form of payment is acceptable.

After return of the motorhome, Chelston Motorhome Hire will reimburse the security deposit within 1 week following the return of the motorhome, taking into account any claims under the rental contract.

TERMS OF PAYMENT

A deposit of 25% of the hire fee is payable within 48 hours of placing the booking. Should a booking be made within 6 weeks of the hire period then the full amount is payable immediately.

If a deposit of 25% is paid then the remaining 75% is payable 6 weeks before the due date.

The Security Deposit must be paid within 5 working days before the collection date of the motorhome.

CANCELLATION AND CHANGE OF BOOKING

Should you need to cancel your booking the following charges will apply:

  • More than 6 weeks before the collection date; deposit of 25% to be retained by Chelston Motorhome Hire.
  • Less than 6 weeks but more than 2 weeks – 50% of total hire charge to be retained by Chelston Motorhome Hire.
  • Less than 2 weeks or no show – 100% of total hire charges to be retained by Chelston Motorhome Hire.

All Cancellations must be in writing; hirers are advised to take out travel insurance or to insure against unavoidable cancellation.

Should you need to change your booking:

  • If the booking needs to be changed, the first course of action is to contact Chelston Motorhome Hire directly in writing to set out the changes required and the reason for the changes. Chelston Motorhome Hire will wherever possible try and accommodate the changes; any changes that are made may incur an administration fee of £50.

COLLECTION AND RETURN

The Motorhome is handed over to the hirer in the condition as set down in the contract. On both, collection and return of the motorhome, the condition is recorded by both parties and confirmed by signature on the form, which forms part of the contract.

The hirer is under obligation to participate in a Handover that will explain how the various motorhome systems operate; in addition a written summary of the operation of the systems is provided for each motorhome. Chelston Motorhome Hire will not be held responsible for the hirer not understanding how the various systems operate and responsibility therefore lies with the hirer in all circumstances to ask about any aspect of which they are uncertain.

If there is no motorhome of the specification ordered by the hirer available at the time of collection, Chelston Motorhome Hire reserves the right to make available a comparable or larger motorhome. In such cases the hirer will not incur any additional rental costs. Should a smaller vehicle be made available the price difference will be reimbursed by Chelston Motorhome Hire.

The motorhome will need to be collected on the same day as the booking between 14.00 hrs and 16.00 hrs and returned from Monday to Friday between 10.00 hrs and 11.00 hrs. The dates and times stated in the contract prevail at all times, save for amendment agreed by both parties in writing. On Sundays and Bank Holidays, collections and returns are not possible.

The hirer is obliged to return the motorhome according to contract at the agreed place upon expiry of the agreed hire period and to complete the return procedure with a member of Chelston Motorhome Hire staff which takes approximately 30 minutes.

Should the motorhome be returned up to two hours late a penalty charge of £100 will be applied, should it be returned after that time a full days hire will be added to the penalty charge.

There will be no reimbursement for late collections or an early return.

The motorhome is to be returned with the toilet cassette emptied, the waste tank empty and the interior of the motorhome clean. The outside of the motorhome may be left uncleaned as long as there is no excessive dirt caused by driving the vehicle off the highway. In the case of the toilet not being  emptied a penalty charge of £50 will be applied. In the case of the waste tank not being emptied a penalty charge of £50 will be applied. In the case of the interior or exterior requiring cleaning, a charge of £150 for each will be applied.

The motorhome is supplied with two 6kg gas bottles which at least one will be full on collection, the gas used from these bottles by the hirer is supplied without any further charge. 

The motorhome is supplied with a full tank of Diesel Fuel and must be returned in the same condition; failure to adhere to this will incur a refilling fee of £50 plus the amount of fuel used to fill the tank up.

FINES

Parking and Speeding Fines:

All parking and speeding fines are the responsibility of the hirer and any fines received by Chelston Motorhome hire will be returned to the sender, advising them of the hirer details. In such cases a £50 administration fee may be charged.

Toll Charges:

Any toll charges such as for the Dartford Tunnel or Congestion Charges that are required to be paid via the internet must be paid for immediately by the hirer; should these not be paid the hirer will be recharged at the cost presented to Chelston Motorhome Hire plus an administration fee of £50.

Mileage Limitations:

There is an average limit of 125 miles a day (per 24 hours) should this is exceeded, extra miles are charged at 50p per mile.

SMOKING

All motorhomes are non smoking; should the motorhome be returned having been contaminated by smoke from a cigarette/ pipe/ cigar etc or vapour from a E Cigarette then the hirer is liable for an immediate penalty charge of £150. In addition should the cleaning of the vehicle result in the motorhome being delayed for hire to other customers, the hirer will be liable for any loss by Chelston Motorhome Hire.

PETS

Chelston Motorhome Hire will allow up to two medium size dogs in the motorhome; a charge of £25 will apply for each dog per week or part of. The dogs must be well behaved, not to climb on the upholstery or beds and be restrained whilst travelling. When the motorhome is returned, the hirer should ensure that they have cleaned the motorhome interior thoroughly to remove all traces of pet hair etc. If the motorhome has not been cleaned to an acceptable condition, the hirer will be charged a cleaning fee of £150.

NOTIFICATION OF DEFECTS 

The hirer must immediately communicate with Chelston Motorhome Hire any defects identified with the motorhome.

Should an on-board system fail during the hire period, Chelston Motorhome Hire will make every effort to remedy the fault whilst you are away.

In some circumstances, this may not be possible and Chelston Motorhome Hire cannot be held responsible and will not automatically refund any monies should a loss of service be encountered nor have any obligation to provide a replacement motorhome.

In the case of winter hire, Chelston Motorhome Hire will not be and cannot be held responsible in the event of any damage or inconveniences caused by freezing conditions.

Should the failure of a system be considered by the hirer to have detracted from their ability to use the motorhome, then the hirer should file their reasons for claiming compensation in writing within 28 days of their return of the motorhome. Chelston Motorhome Hire will respond within a further period of 28 days confirming their decision.

WHAT TO DO IN THE EVENT OF AN ACCIDENT

Each motorhome is supplied with both Accident and Damage report forms that must be fully completed at the time of the incident or a accident  and within 24hours the problem must be reported to Chelston Motorhome Hire by phone/ e mail.

Should the accident involve a third party, the police must be informed.

REPAIRS, REPLACEMENT VEHICLE

Repairs that become necessary to ensure the operating and road worthy condition of the motorhome must be authorised by Chelston Motorhome Hire.

Any costs once authorised will be refunded by Chelston Motorhome Hire against submission of the respective original invoice and any displaced parts that had been replaced provided the hirer is not liable for the defect. See below for Windscreens and Tyre replacement.

If the motorhome is destroyed without any fault on the part of the hirer or if it is foreseeable that the use of the motorhome will be prevented for a unreasonable long period of time, Chelston Motorhome Hire will use all reasonable endeavours to replace the motorhome in a reasonable time. If the motorhome is of equivalent specification, the contract cannot be terminated  by the hirer. Should the replacement vehicle not be of equivalent specification then the hirer can choose to accept the motorhome or terminate the contract.

If the motorhome is destroyed due to the hirers fault or if it is foreseeable that the use of the motorhome will be prevented from use for an unreasonably long period of time due to the hirer’s fault, Chelston Motorhome Hire may refuse the provision of a replacement motorhome, in such situations, termination of the contract by the hirer is excluded.

Windscreen:

Should a windscreen become damaged where the extent of the damage would fail a MOT, the screen must be replaced by the hirer at their cost. Should the motorhome be returned and the windscreen requires replacement, the cost of a replacement windscreen will be recharged to the hirer.

Tyres:

The motorhome is not supplied with a spare wheel; it is provided with an inflation kit that will temporarily resolve any minor punctures allowing the motorhome to de driven to a local garage for a permanent repair/ replacement tyre; any puncture repair costs are not reclaimable from Chelston Motorhome Hire. Should a tyre be un-repairable, the hirer must replace the tyre with a compatible tyre for the motorhome application at their own cost. Should the motorhome be returned from hire with either an incompatible tyre or a tyre that is not legal through damage, a replacement tyre of the correct specification will be fitted by Chelston Motorhome Hire and the cost recharged to the hirer. Should the inflation kit be used then the hirer should inform Chelston Motorhome Hire on their return, so as to ensure the inflation kit is replaced and the tyre checked by the technical staff.

PROHIBITED USE, DUTY OF CARE

The hirer agrees that during the rental period, they will not and will not allow the motorhome to:

  • Be driven otherwise than in a cautious, prudent and normal manner.
  • Be driven at speeds in excess of the speed limits.
  • Be used in a manner which could cause damage to the motorhome or other road users or pedestrians
  • Be driven within a prohibited area.
  • Be driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted in law.
  • Be left with the ignition key in the motorhome while it is unoccupied.
  • Be driven by persons not approved by Chelston Motorhome Hire.
  • Be damaged by submersion in water or contact with salt water.
  • Be used for any race, rally or contest.
  • Be used to tow any vehicle or trailer.
  • Be used to carry passengers or property for hire or reward.
  • Be used to carry more persons than is permitted by the design of vehicle determined by the number of EEC seat belt systems fitted.
  • Be used to carry volatile liquids, gases (other than the gas bottle installed), explosives or other corrosive or inflammable material.
  • Make any alterations to the motorhome without Chelston Motorhome Hire approval.
  • Fill the Fresh water tank with anything but water fit for human consumption.

The hirer agrees during the rental period to:

  • Check that the Engine Oil level and Coolant level are correct on a weekly basis.
  • Ensure the tyre pressures are maintained to the recommended pressures.
  • Inform Chelston Motorhome Hire of any damage occurring be that caused by accident, incident, mis–use or failure of a system, so that Chelston Motorhome Hire can order replacement parts for fitting or otherwise assess the motorhome prior to the next rental.

DRIVING THE MOTORHOME OUTSIDE THE UK

The minimum hire period for motorhomes used outside the UK is 7 nights.

Chelston Motorhome Hire motorhomes may be taken outside the UK to the following countries:  Austria, Belgium, France, Germany, Italy, Luxembourg, Netherlands, Portugal, Republic of Ireland, Spain and Switzerland.

Using the motorhome outside the UK will incur an increased cost to the insurance excess plus there is also an additional charge to the rental fee to cover increased costs for insurance and roadside assistance which are as follows:

  • 0 – 7 nights = £125
  • 0 – 14 nights – £230
  • 0 – 28 nights – £320

Also provided within the above mentioned costs is a EU Travel Kit:

  • I x bulb kit
  • 2 x breathalyser kit
  • Continental adaptor for mains lead
  • Headlamp Beam Deflectors
  • Gas system re-fill adaptors for EU use.
  • VE103B form

ROADSIDE ASSISTANCE

In the event of a mechanical breakdown, the vehicle is covered by FIAT Camper Assist.

FIAT Camper Assist will also support the hirer should they be involved in an accident, have a flat engine battery, have a puncture or have a fuel related problem.

TERMINATION

Chelston Motorhome Hire reserve the right to terminate the rental contract for good cause without observing a notice period, in particular when the hirer subjects the vehicle to a use in breach of contract or any breach of law.  It should be noted that the motorhome is fitted with a Tracker to enable Chelston Motorhome Hire to monitor the location and use of the motorhome.

DATA PROTECTION

The personal data you provide will be used solely by Chelston Motorhome hire for the purpose of administering the hire of the motorhome. Your personal data will not be passed onto any third parties.

GOVERNING LAW

This agreement is governed by the law of England and Wales.
